Transvaginal Mesh Cases Moved to West Virginia

The lawsuits against three manufacturers of transvaginal mesh implants have been consolidated before one federal judge in Charleston, West Virginia.  The Judicial Panel on Multidistrict Litigation issued an order on February 7, 2012 to transfer the lawsuits from across the United States to Judge Godwin who presides over the court in Charleston.

 
Judge Godwin had already been handling a multidistrict litigation involving the C.R. Bard Avaulta mesh for several years.  The panel stated in their order that the defects claimed in all of the transvaginal mesh products were similar and Judge Godwin could use his prior experience to expedite the litigation.  The three manufacturers added to the proceedings were American Medical Systems, Inc. (AMS), Boston Scientific Corp., and Ethicon, Inc. (Johnson & Johnson).
 
There has been much controversy regarding these devices in the last several months.  The FDA recently held an advisory meeting because of concern about the increased reports of complaints and injuries from women who were implanted with the mesh.  As a result, the FDA is now collecting information to decide if it is necessary to recall these devices.  In many cases, the mesh has extruded through the vaginal wall causing pain and bleeding, and it is sometimes necessary to undergo surgery to attempt to trim the mesh or remove it.
