Pfizer, the maker of the antidepressant drug, Zoloft, has filed a motion with the Judicial Panel on Multidistrict Litigation asking that 59 lawsuits filed in Federal Court across the country be centralized in one court, before one judge. The lawsuits include product liability claims alleging that Zoloft caused birth defects.
Zoloft was approved by the FDA in 1991 for treatment of major depressive disorder. Generic versions of the drug became available in 2006. Presently there are 48 cases pending in the Eastern District of Pennsylvania, 5 cases pending in the Southern District of New York, 2 cases in the Southern District of Illinois and one case each in the Northern District of Mississippi, the Southern District of Mississippi, the Eastern District of Missouri and the Northern District of Ohio.
Pfizer has requested the panel to centralize all of the litigation in the Southern District of New York, where its headquarters are located. Alternatively, they asked for either the Northern District or the Southern District of Mississippi or the Northern District of Ohio.
